Lemon Law Protections Available in Wisconsin

Wisconsin Lemon Law covers the first year after you purchase or lease a new motor vehicle, including cars, trucks, and motorcycles. Claims usually involve:

  • Four Repairs for the Same Problem: If your car needs work four times for the same problem within one year of purchase and the problem continues, the manufacturer has a duty to replace your vehicle or give you a refund of the full purchase price.
  • 30 Days or More Out of Service: If your vehicle is out of service for 30 days during the first year after delivery, you are entitled to a replacement vehicle or a full refund. Thirty days is not limited to only days that your vehicle is in the repair shop.
  • Failure to Repair a Problem: If you brought your vehicle in to be fixed at least once during the first year, and the problem continued after the first year, you can recover damages.

For problems that begin after the first year, but within the warranty period, you must appeal to the Magnuson-Moss Warranty Act.

Simply notifying the manufacturer that you know you are entitled to a refund or replacement is usually not enough. Often, they outright lie to avoid responsibility. But if the Lemon Law is violated in Wisconsin, know that you are entitled to double damages plus attorneys' fees.
